Candidate Privacy Statement

This Applicant and Candidate Privacy Statement (“Statement”) describes the Personal Information we, Material Holdings, LLC, collect about you in the context of your candidacy for employment with us and/or our subsidiaries (collectively referred to as “we,” “us,” “our,” or “Material”).

If you are a California-resident, please also refer to our Privacy Notice for California Resident Personnel and Business Service Providers (“California Privacy Notice”). In the event these terms conflict with the terms of the California Privacy Notice, the latter shall prevail.

Does Material Collect My Personal Information?

Yes. The Personal Information we collect and process is described in this Statement. The terms “Personal Information” and “Personal Data” are used interchangeably and are defined in accordance with our Privacy Notice.

For clarity, Personal Information does not include information that is aggregated and de-identified nor information that cannot be reasonably linked to you.

Why Is Material Collecting My Personal Information?

It is necessary for us to process information about you for purposes of considering your candidacy.

What Categories of Personal Information Are You Requesting?

The categories of Personal Information we may collect about you, which may include Sensitive Personal Information (as defined in the California Privacy Notice) include, without limitation:

  • Contact Information and Personal Identifiers, including your name, location, phone number, email address, etc.
  • Biographical and Background Information, including your work permit or visa information, employment and education history, referrals or references, whether you are subject to any prior employer obligations, and any other information you make publicly available (e.g. your LinkedIn profile) or you provide to us (such as information included in your resume, cover letter, or on your Career Profile). The information we collect may include data we collect from third-parties.
  • Data with Special Protections, like your gender, and health information. This may also include any special needs or health conditions, and information relating to accommodations that you may request during the recruiting process, if you disclose such information.
  • Professional or Employment Information and Preferences, including current and/or desired salary and other terms relating to compensation and benefits packages, willingness to relocate, other job preferences, interview details, and outcomes of any recruiting exercises you complete.

What is the Purpose For Using My Personal Information?

We use the Personal Information described in this notice solely in the context of your candidacy (and, if selected, your employment) at Material and also in connection with the improvement of our recruiting processes. In addition to these purposes, we collect this information for the following purposes (when appropriate):

  • to receive, review, reply to and otherwise communicate with you about your application and candidacy;
  • to verify the information you or others provide, and to check your references;
  • to assess and confirm your skills and suitability for the opportunity you applied for, and in certain cases, for other opportunities at Material;
  • to facilitate the interview and recruitment process;
  • to prepare an offer letter, if your application is successful;
  • if you were referred to Material by someone, to inform the referrer of the status and final outcome of your application;
  • to suggest additional suitable opportunities for you at Material, invite you to recruiting events we organize or sponsor, to send you alerts or recommendations about opportunities at Material, or ask you for updates to your availability. You can opt-out of these communications at any time;
  • to maintain and improve our recruiting processes and recruitment applications, for internal planning and management reporting;
  • to maintain the safety, integrity, health and security of Material, its employees, and others as required or permitted by law;
  • assisting you with obtaining an immigration visa or work permit;
  • as part of our commitment to equal opportunity employment. This may include associating you with sensitive and/or demographic information; and
  • to comply with applicable law, regulation, legal order or proceeding, and to defend your or our interests in actual or threatened proceedings or investigations.

Who May Have Access to My Information (and For What Purpose)?

  • In addition to Material collecting and processing your Personal Information and other information related to your candidacy, your information may be shared with our affiliates, subsidiaries or joint ventures in the US and in other jurisdictions, in relation to the purposes described above. In some cases, if we determine that you have a common background with a current Material employee, we may consult with that employee for feedback about your candidacy.
  • Material may also use service providers acting on Material’s behalf to perform some of the services described above, including for the purposes of the verification / background checks. These service providers may be located outside the country in which you live or the country where the position you have applied for is located and the data will be shared in accordance with the appropriate data transfer mechanisms available under the circumstances.
  • Material may sometimes be required to disclose your information to local labor authorities, courts and tribunals, regulatory bodies and/or law enforcement agencies for the purpose of complying with applicable laws and regulations, or in response to legal process..
  • Material will also share your personal information with other third parties if we have your consent (for example if you have given us permission to contact your references).

Where is My Personal Information Processed?

  • Material operates globally, which means your information may be stored and processed outside of the country or region where it was originally collected including in the United States. In some of these countries, you may have fewer rights in respect of your information than you do in your country of residence. Regardless of where your information is processed, we apply the same protections described in this policy and in our Privacy Policy.

How Long Is My Personal Information Retained?

If you apply for a job at Material and your application is unsuccessful (or you withdraw from the process or decline our offer), Material will retain your information for at least three (3) years (and in some cases longer when there is a legal, contractual or other binding requirement to do so. We retain this information for various reasons, including in case we face a legal challenge in respect of a recruitment decision, or to consider you for other current or future jobs at Material and to help us better understand, analyze and improve our recruitment processes.

If you do not want us to retain your information (for example, for consideration for other roles), or want us to update it, please contact privacy@materialgrowth.com. Please note, however, that we may nevertheless retain some information if required by law or as necessary to protect ourselves from legal claims.

What if EU Data Protection or UK Data Protection Law Applies to the
Processing of my Information; What is your legal basis for processing it?

In addition to the previously stated categories and purposes of data processing, we also process your Personal Information for legitimate interests to ensure we recruit the best possible candidates.
